The EU has today changed the network by adopting two giga laws

The Digital Markets Act and the Digital Services Act that we have written about before are now both approved as law by the EU.

The DSA Act will be activated on 1 January 2024, while the DMA Act will be implemented shortly afterward.

 

This is the DMA Act
The Digital Markets Act, which we explained in March this year, opens up, among other things, for instant messaging across platforms - let's consider it first:

 

“Users of small or large platforms will be able to exchange messages, send files or make video calls across messaging apps, thus giving them more choices. With regard to the interoperability obligation for social networks, co-legislators agreed that such interoperability provisions will be considered in the future. ”

 

Love also says that point-to-point encryption of group chats must be in place, and as quickly as possible.

 

The DMA Act is activated if the company that operates the platform has at least 45 million monthly users in the EU and over 10,000 business users annually. If the companies do not comply with the law, they risk fines of up to 10 percent of turnover or as much as 20 percent if the rules are broken several times.

 

It's about more than messages
The law covers more than messaging apps, as the EU also wants full control over which apps and services run on the mobile with the option for users to uninstall pre-installed software and choices about which services the user wants to use when setting up the device for the first time.

 

The second point in the law is that companies such as sell their products on Amazon get access to the company's analysis figures for the company that offers the products. It is also desired that companies that trade ads on platforms such as Facebook are allowed to use external tools to verify that the ad numbers are correct.

 

Companies are also not allowed to place ads for their own products at the top of their own services and programs.

 

This is the Digital Services Act
The DSA law is largely about what the big companies can do with your data, and not least this is very interesting:

 

"The most interesting thing is without a doubt Google's holy grail: the algorithm that sorts searches and is the reason why they dominate web searches. Now, it is not the case that Google will have to reveal the algorithm to you and me, but they will have to explain to users and researchers how it works - we do not expect that the EU will not force Google to disclose copyrighted material. Large companies will also have to provide experts with information on how online risks change. ”

 

Another interesting improvement will be that Facebook and similar services will have to offer chronological sorting of content, and at the same time make the algorithm that recommends content visible to users.

 

The EU says large companies must take action against what they define as misinformation
The EU wants companies to take tougher action against spreading misinformation, without explaining who will decide what is correct and what is wrong. This law will be particularly important during crises, according to the EU.

 

Several of the largest measures apply only to "very large search engines with more than 10 percent of the 450 million consumers in the EU."

 

The aim is to give them greater responsibility in stopping illegal online content, and “very large online platforms that reach more than 10 percent of 450 million consumers in the EU and which can therefore pose a particular risk of spreading illegal content and harming society. ” Content that is removed must be substantiated, and an appeal process has been baked in.

 

These are hefty fines for the big ones, as the EU uses percentage fines: up to six percent of annual turnover risks rich companies such as Meta (earned almost $ 40 billion last year) and Google ($ 75 billion in revenue in 2021).
